DMCA Policy

WhirLocal Media Group, LLC (“Company”) respects the intellectual property rights of others and expects it’s users to do the same while using the Platform. In accordance with the Digital Millenium Copyright Act (DMCA), if you believe your copyright-protected work has been posted on the Platform without your authorization, you may submit a notice of copyright infringement.

As with all legal issues, you should consult with a professional about your specific situation. This is not legal advice.

BEFORE YOU START

Before you submit a copyright infringement notice, please do these things first:

  • Investigate thoroughly; be sure that the user does not have permission to use your copyright-protected work
  • Tell the truth; don’t make false claims
  • Ask nicely; reach out directly to the user and ask them to remove the content
  • Do NOT use bots

SUBMIT A NOTICE

In order to submit a copyright infringement notice “DMCA Take Down Notice”, the notification should meet the following requirements:

  • An electronic or physical signature of the copyrighted work owner (or authorized person)
  • A description of the copyrighted work, including the URL on the Platform where this infringing content is available or a copy of it
  • Your contact details: email address, telephone, and address
  • A statement in “good faith belief” that the work is not authorized to be published on the Platform by the copyright owner
  • A statement by you, the person who sends the takedown notice, that the information you send in the notice (above information) is accurate and that you are either the copyright owner or you are authorized to act on copyright owner’s behalf

DMCA PROCESS

Once a proper, bona fide infringement notice has been received and determined to be true, it is the Company’s policy to:

  • remove or disable access to the infringing material
  • notify the content provider, member or user that it has removed or disabled access to the material; and
  • that repeat offenders will have the infringing material removed from the system and that Company will terminate such content provider’s, member’s or user’s access to the service.

SUBMIT A COUNTER NOTICE

If you believe content you published was taken down by mistake by a Takedown Request, you have the right to contest the takedown by submitting a counter-notice.
