The plea negotiation process is usually an evolving thing during the course of a criminal case. There are a lot of factors that influence plea negotiations, like the relative strength or weakness of the evidence against you, legal issues present that allow us to attack the government’s case, and mitigation factors, like the absence of any criminal history, or your overall role in the alleged commission of the crime, among other things.
Whether a case resolves or not can also depend on the prosecutor on the case.
