Awful Claim Process
Well I decided to update my review so people know that they do not have to let this company take advantage of you, which is what they tried to do to me. My loss occurred last year on August 27, 2019. Their insured owns a car wash business and their diseased Bradford pear tree fell into our yard and did almost $10,000 of damage, including over $5000 to one of our customer's cars. This insurance company fought me EVERY step of the way. They would tell me they needed something and I would supply it (I even paid an Arborist $300 for a report), and they would tell me it did not work. They never showed any proof that their insured did their minimum duty of care in regards to the tree. I asked the VP of claims (he wanted to talk to me after my previous review after months of being ignored even by the adjuster!) if I took his client to small claims court would they pay then? He said yes. So guess what I had to do to make this awful company do the right thing. I had to take his insured to small claims court! In the judgement, the judge said "It is also significant that the defendant is a commercial business, its representative even testifying that the tree provided shade to employees who gathered under it. The defendant was thus not only under the duty of a reasonable occupant of land but also under a duty to inspect potential workplace dangers affecting its employees." So we won and have received checks for what the judge ordered. We still lost on time and money though. Estimates to fix vehicles are never accurate, and always more once they tear it apart. We only got paid for the estimate and there were a few other things that we did not get paid for, like the Arborist report that Chris Strain wanted me to get and then said his insured could not be held to the same standard as an arborist. I hope their insured finds a new insurance company that does the right thing for them in the future. That's why businesses pay insurance companies. Oregon Mutual must have missed that memo though because a year after the incident, their insured had to go to court to deal with something that should have already been handled. Save yourself a headache and run away before you've paid them a buttload of money and when an accident happens, they don't pay.
