This past spring, we decided last minute to take a spring break family trip to Cozumel. Carrie at Fun by Fischer Travel was very quick to send us options on places to stay. She paid close attention to our special requests for the type of resort we were looking for and found the perfect place for us to stay. She also shared travel tips to make sure we had an amazing, fun, and relaxing trip! Please read these terms and conditions carefully before proceeding with any booking or transactions through Fun by Fischer Travel. By using the services provided by Fun by Fischer Travel or its website www.funbyfischertravel.com, you agree to be bound by the following terms and conditions. These terms and conditions constitute a legally binding agreement between you and Fun by Fischer Travel. Your use of our services and website signifies your acceptance of these terms and conditions and your willingness to comply with them.

"Travel Agency": Refers to Fun by Fischer Travel, and may be referred to as “we”, or “ours” the company providing travel-related services and operating under these terms and conditions.
"Client": Refers to any individual, group, “you” or “your” or entity using the services of Fun by Fischer Travel to book or arrange travel-related services.
"Services": Refers to the travel-related products and services offered by Fun by Fischer Travel, including but not limited to booking flights, accommodations, tours, transportation, and travel insurance.
"Website": Refers to the official website of Fun by Fischer Travel, accessible at www.funbyfischertravel.com, and interact with the agency's online platform. This also includes the Client Portal, accessible at https://crm.myagentgenie.com/portal/dashboard/home.
"Itinerary": Refers to a detailed schedule or plan of travel-related services, including flight details, accommodation reservations, and activities.
"Payment": Refers to the funds provided by the client to suppliers in exchange for the services rendered.
"Cancellation": Refers to the act of terminating or voiding a booking or reservation, which may be subject to specific cancellation policies.
"Refund": Refers to the return of funds to the client for unused or canceled travel-related services, "Travel Documentation": Refers to the required travel documents, including passports, visas, and travel permits, necessary for international travel.
"Force Majeure": Refers to unforeseen and uncontrollable circumstances, such as natural disasters, acts of terrorism, or government actions, that may impact the provision of travel-related services.
"Dispute Resolution": Refers to the process of resolving conflicts, disagreements, or disputes between the client and Fun by Fischer Travel, as outlined in the terms and conditions.
"Governing Law": Refers to the specific jurisdiction and legal framework that governs the interpretation and enforcement of these terms and conditions.
Client Responsibilities:
As a client using the services of Fun by Fischer Travel, you acknowledge and agree to the following responsibilities:
Accurate Information: Provide accurate and complete personal information, including names, contact details, and travel preferences, when making bookings or reservations. Including how your name exactly appears on your travel documents, including your passport.
Travel Documentation: Ensure that you possess the required travel documents, including passports, visas, and any necessary permits, for all destinations included in your travel itinerary.
Payment Obligations: Adhere to the payment schedule and guidelines outlined byFun by Fischer Travel. Ensure that payments for travel services are made promptly and by the agreed-upon terms.
Passport Validity: Ensure that your passport is current, valid, and up to date for the entire duration of your travel itinerary, as required by the countries you will visit.
Review and Verify: Review all travel itineraries, booking confirmations, and other documentation provided by Fun by Fischer Travel for accuracy and promptly notify the agency of any discrepancies or concerns.
Compliance with Laws: Abide by all applicable laws, regulations, and travel requirements of the countries you will visit. Fun by Fischer is not responsible for any legal issues resulting from your failure to comply.
Travel Insurance: Consider and purchase travel insurance, if desired, to protect against unforeseen events, cancellations, and travel-related emergencies. Fun by Fischer Travel can provide information on available insurance options. Please be aware that for specific travel insurance policies, there is a limited window of time within which you must complete your purchase following booking.
Health and Vaccinations: It is your responsibility to ensure that your health and vaccinations are up to date and in compliance with the requirements for your travel destinations. Please check on a government-approved website for any health advisories for any countries you plan to visit. Consult with healthcare professionals as needed.
Contact Information: Maintain up-to-date contact information with Fun by Fischer Travel to ensure effective communication throughout the travel booking and planning process.
Travel Conduct: Behave responsibly and respectfully while traveling, including following the rules and regulations of airlines, hotels, transportation providers, and tourist attractions.
Communication: Inform Fun by Fischer Travel of any special requests, preferences, dietary restrictions, or mobility needs at the time of booking or as soon as possible during the booking process to facilitate appropriate accommodations.
Emergency Contact: Provide an emergency contact person and contact information that can be used in case of travel-related emergencies.
Dispute Resolution: Cooperate in good faith with any dispute resolution procedures outlined in these terms and conditions in the event of conflicts or disagreements.
Feedback: Share feedback and comments regarding your travel experience withFun by Fischer Travel to help improve our services and address any concerns promptly.
Your compliance with these responsibilities is essential to ensuring a smooth and enjoyable travel experience. Failure to meet these responsibilities may result in disruptions to your travel plans, or extra fees for which Fun by Fischer Travel cannot be held liable.
Traveler Responsibility:
Travelers are responsible for reviewing and complying with the terms and conditions, policies, and regulations of third-party service providers, including airlines, hotels, and transportation companies. Provider shall not be liable for any penalties, fees, or expenses incurred by Travelers due to their failure to adhere to these terms and conditions.
Cancellation and Refund Policies:
Cancellation by the Client:
a. In the event of a cancellation, please notify Fun by Fischer in writing promptly.
b. Cancellation fees, if applicable, are determined by the respective third-party suppliers and their policies. These fees may vary depending on the timing of the cancellation.
c. Specific cancellation policies, including fees, for services such as airline tickets or non-refundable accommodations, are governed by the policies of the individual suppliers.
d. Fun by Fischer Travel ("Agency") reserves the right to withhold fees, when deemed necessary, based on the specific circumstances of a booking or transaction. This reservation may apply to situations that require additional processing, dispute resolution, or other exceptional circumstances. Any such fee withholding will be communicated to the affected parties with a clear explanation of the reasons.
Cancellation by Fun by Fischer:
a. Fun by Fischer is necessitated to cancel your booking due to unforeseen circumstances beyond our control, you will be promptly informed.
b. Please be aware that Fun by Fischer does not handle direct payments. Any refunds owed to you will be the responsibility of the respective travel service providers, such as airlines or accommodations.
c. While we will assist you in facilitating refunds or alternative arrangements with the suppliers, the timeliness and availability of refunds are subject to the policies and procedures of these providers.
d. Travelers are encouraged to review the cancellation and refund policies of individual suppliers for specific terms and conditions related to the return of funds in case of cancellations.
Refunds:
Fun by Fischer reserves the right to deduct any applicable cancellation fees, administrative costs, or non-refundable portions of travel services from the refund amount.
Travel Insurance:
We strongly recommend clients consider purchasing travel insurance for coverage in the event of cancellations, interruptions, delays, medical emergencies, and lost luggage, though not all reasons are covered. Please consult Fun by Fischer for insurance options or clarification. The purchase and terms of travel insurance are separate agreements between clients and insurance providers. Specific cancellation and refund policies may vary by supplier; review them at the time of booking.
If one or more individuals sharing a room decide to cancel their reservations, the travel insurance will not cover the difference required to switch to a single occupancy rate. This cost adjustment will be the responsibility of the guest(s) who choose to continue their reservation.
Liability for Changes, Cancellations, Delays:
Fun by Fischer Travel serves as an intermediary between clients and travel service providers (e.g., airlines, hotels, tour operators), and while we strive for seamless travel experiences, we are not responsible for:
Itinerary Changes: Providers may alter itineraries for various reasons, and we bear no liability for such changes.
Cancellations: Any disruptions or costs resulting from provider cancellations are not Fun by Fischer Travel’s responsibility.
Delays: We do not accept liability for transportation delays or missed connections.
Itinerary Modifications: We are not responsible for modifications initiated by providers.
Clients should consult providers for their policies. Considering travel insurance is advisable to mitigate potential losses due to disruptions beyond our control. By engaging our services, you acknowledge our limited liability for unforeseen circumstances and are encouraged to stay informed and prepared for travel uncertainties.
Limitation of Liability:
Travelers acknowledge and agree that Provider shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, lost profits, personal injury, property damage, or any other losses resulting from the actions or inactions of Travelers, third-party service providers, or any other party involved in travel arrangements. Provider's liability is expressly limited to the cost of the services provided by Provider.
Booking and Reservation Procedures:
Fun by Fischer Travel ("Agency") facilitates bookings and reservations with third-party suppliers on behalf of travelers. Please note that we do not process payments directly. All payments are made to the respective suppliers as per their terms and conditions.
Ownership of Intellectual Property:
All intellectual property, including but not limited to trademarks, copyrights, and patents, associated with the product or service provided by Fun by Fischer Travel ("Carrie Fischer") shall remain the sole and exclusive property of the Owner. This includes but is not limited to, emails, guides, written content, and any other materials created by the Owner in the course of providing the product or service.
Usage Rights: Users are granted a limited, non-transferable license to use the intellectual property for personal or internal business purposes as per this Agreement.
Restrictions:Users may not reproduce, distribute, modify, create derivative works, or exploit the intellectual property without written authorization.
Attribution: Users must provide proper attribution when using or sharing the Owner's content.
No Redistribution: Users are prohibited from redistributing the Owner's intellectual property, including but not limited to emails, guides, Tips and Tricks, and other materials, to third parties without the explicit written consent of the Owner.
Enforcement of Rights: The Owner can enforce its intellectual property rights, seeking legal remedies for unauthorized use.
No Transfer of Ownership: This Agreement does not confer ownership rights; users have a limited license.
By accessing or using the product or service provided by the Owner, users agree to abide by the terms of this Intellectual Property Clause. Failure to comply with these terms may result in legal action.
Privacy and Data Handling:
Personal Information: We collect, use, and protect your personal data for travel bookings, communications, legal requirements, and sharing with travel providers.
Data Security: We ensure data security and confidentiality against unauthorized access or disclosure.
Sharing: We share client data with travel providers as needed for bookings.
Data Retention: We retain data only for necessary purposes and legal compliance.
Consent and Access: By using our services, you consent to data handling and can access or correct your information.
Opt-Out: You may limit data provided, affecting service availability.
Website Data: We use cookies for site functionality and analytics.
Third-Party Links: External site privacy practices aren't our responsibility.
Policy Updates: We may update this policy and will inform clients of significant changes.

Responsibility for Information Accuracy and Document Review:
Accuracy of Information:
Fun by Fischer Travel ("Company") is committed to providing accurate and up-to-date information in all communications, documents, and materials related to its products or services. However, it is the responsibility of the recipient of such information to verify its accuracy and completeness.
Recipient's Obligation to Review:
The recipient acknowledges that they have a duty to thoroughly review and confirm the accuracy of all documents, communications, itineraries, reservations, travel plans, and other materials provided by the Company. This includes, but is not limited to, travel itineraries, updated travel itineraries, booking confirmations, invoices, travel advisories, and any other relevant documents.
Communication of Errors or Discrepancies:
In the event that the recipient identifies errors, discrepancies, or inaccuracies in any documents or information provided by the Company, the recipient must promptly notify the Company of such errors or discrepancies. The recipient agrees to provide all necessary information to facilitate the correction of any inaccuracies.
No Liability for Unverified Information:
The Company shall not be held liable for any losses, damages, expenses, or inconveniences incurred by the recipient due to the failure to verify the accuracy of the provided information. The recipient acknowledges that their failure to review and confirm the accuracy of documents and information may result in adverse consequences for which the Company shall not be responsible.
Disclaimer:
While the Company strives to provide accurate and reliable information, it is not responsible for changes, updates, or circumstances that may occur after the information has been provided. Travel-related information, in particular, is subject to change, and the recipient is advised to verify all details directly with the relevant service providers.
Payment and Billing Pricing
For services where payment is made directly to third-party suppliers, Fun by Fischer Travel. ("Agency") will facilitate payments as per the supplier's terms and conditions. Travelers may have the option to arrange payment plans through suppliers options or pre-approve payments through the client portal. Refunds, if applicable, will be issued by the third-party suppliers. Fun by Fischer will provide billing and payment details from these suppliers as needed.
This clause succinctly conveys that payment to third-party suppliers will be facilitated by the agency and outlines the options for travelers regarding payment plans and pre-approval. It also clarifies that refunds will be handled by the third-party suppliers and mentions the agency's role in providing billing and payment details.
Payment Fees:
Fun by Fischer ("Agency") reserves the right to impose payment fees if deemed necessary, either at present or in the future. Any such fees will be communicated to travelers in advance.
Termination and Suspension:
Termination by Agency: We may terminate access to shared documents, guides, and the client portal at our discretion for violations or conduct detrimental to us, with or without notice.
Termination by Client/User: You can request termination by providing written notice, processed promptly.
Effect of Termination/Suspension: Upon termination/suspension, stop using these services. We may retain necessary documents for legal obligations.
No Liability: We're not liable for losses due to termination/suspension, whether initiated by us or you.
Client Obligations: Retrieve your needed materials upon termination as we are not obligated to maintain access.
Survival of Terms: Other terms remain valid after termination to the extent necessary.
Dispute Resolution:
In the event of any dispute or disagreement arising out of or related to this contract (the "Contract"), the parties involved shall make every reasonable effort to resolve such disputes amicably and in good faith through negotiation and consultation.
If the parties are unable to reach a mutually satisfactory resolution through negotiation within 90 days of the dispute arising, either party may initiate the following dispute resolution process:
Mediation: The parties agree to engage in mediation with a qualified mediator chosen jointly or appointed by Cruises and Tours Unlimited. Mediation shall take place within 60 days of the initiation of the dispute resolution process. The mediator's fees and expenses shall be borne equally by the parties unless they agree otherwise.
Arbitration: If mediation does not result in a resolution of the dispute within 45 days after it has commenced, or if either party refuses or fails to participate in mediation, the dispute shall be referred to binding arbitration. The arbitration shall be conducted per the rules and procedures of the selected arbitrator, and a single arbitrator shall be selected per those rules. The decision of the arbitrator shall be final and binding upon both parties, and judgment upon the award rendered may be entered in any court having jurisdiction.

Travel Laws Documentation:
Fun by Fischer ("Provider") is committed to providing assistance and guidance to travelers ("Travelers") in understanding and complying with travel laws and documentation requirements. Provider may offer information, advice, or resources related to travel laws, visa requirements, and necessary documentation. However, Travelers are solely responsible for ensuring that they possess and comply with all required travel documents, such as passports, visas, health certificates, and any other relevant permits or identifications, as mandated by the destination country and relevant authorities.
Third-Party Services:
Provider may facilitate bookings or reservations for accommodations, flights, transportation, or other travel-related services ("Third-Party Services") through various providers, including hotels, airlines, and transportation companies. The provider acts as an intermediary and is not responsible for the actions, errors, omissions, or negligence of these third-party service providers. Any issues, disputes, or claims arising from the provision of Third-Party Services shall be directed to the respective service provider under their terms and conditions.
Assistance and Support:
Provider may offer assistance and support in addressing travel-related issues that Travelers encounter during their trip. However, Travelers acknowledge that the Provider's role is advisory, and any resolutions or remedies must be sought directly with the relevant third-party service provider or authority.
Indemnification:
Travelers agree to indemnify and hold harmless Provider and its agents, employees, and representatives from any claims, liabilities, losses, or damages arising out of Travelers' failure to comply with travel laws, documentation requirements, or the terms and conditions of third-party service providers.
Amendments or Changes to Terms and Conditions:
Notification of Changes:The Agency will notify users of any changes to these terms and conditions via email to the email address provided by the user during the registration process or as subsequently updated in their account settings. Notification emails will include a summary of the changes and a link to the updated terms and conditions on the Agency's website.
Acceptance or Rejection of Updated Terms:Users will have the opportunity to accept or reject the updated terms and conditions by acknowledging their acceptance or rejection on MAGcrm’s client portal. Users must acknowledge their acceptance or rejection within 30 days from the date of notification. Failure to do so within the specified timeframe will be considered as acceptance of the updated terms.
Effect of Rejection:If a user rejects the updated terms and conditions, the Agency reserves the right to terminate their access to the client portal and related services. Users who reject the updated terms will no longer be able to use the Agency's services.
Continued Use as Acceptance:Continued use of the Agency's services, including accessing the client portal, following the effective date of the updated terms and conditions shall be considered as acceptance of those terms.
Review of Changes:Users are encouraged to review the updated terms and conditions carefully and seek legal advice if necessary to fully understand their implications.
Entire Agreement:
Entire Agreement: This agreement, including all its attachments, exhibits, addenda, and any other documents expressly referenced herein, constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, relating to the subject matter herein.
Modification and Waiver: Changes require written, signed agreement; not enforcing a provision doesn't waive its future enforcement
Counterparts: This agreement can be signed in multiple copies, each as valid as the original.
Electronic Signatures: Electronic signatures are legally binding, just like handwritten ones.
Notice: Required written notices go to specified addresses.
Waiver
By engaging the services of Fun by Fischer ("Agency"), the client acknowledges and accepts the inherent risks and uncertainties associated with travel, including but not limited to those arising from natural disasters, political instability, health emergencies, accidents, and unforeseen events.
The client voluntarily assumes all risks and agrees to release, indemnify, and hold harmless the Agency, its officers, employees, agents, and representatives from any claims, liabilities, losses, damages, or expenses arising from or in connection with the client's travel arrangements, including but not limited to those related to transportation, accommodations, activities, and events.
Force Majeure:
Force Majeure: The Agency is not liable for delays, cancellations, or non-performance due to circumstances beyond its control, like natural disasters, war, or pandemics (collectively, 'Force Majeure Event').
Impact on Travel: During a Force Majeure Event, we'll try to arrange alternatives, but if none are available, we may cancel without liability, except as recoverable from suppliers or insurance.
Client Responsibility: Clients must follow government, supplier, and Agency instructions related to Force Majeure Events.
Travel Restrictions and Health Responsibllities:
Travelers are responsible for understanding and complying with all travel restrictions, health requirements, and safety guidelines relevant to their trip. These may include visas, vaccinations, testing, and local regulations.
Documentation and Compliance: Travelers must carry all necessary documents, such as passports, visas, and health certificates, and adhere to guidelines set by authorities and service providers. Non-compliance may result in disruptions or additional costs.
Stay Informed: Travelers should stay informed about destination-specific requirements and updates through official sources. It is their responsibility to keep up with any changes.
Severability Clause:
Serveabillity: If any part of this agreement is found invalid or unenforceable, the remaining provisions will still apply, with the intent preserved.
Modification of Invalid Provisions: Any invalid part will be replaced with a valid one that reflects the original intent.
Effect on Agreement: The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of any other provision of this agreement, which shall remain in effect and enforceable as if the invalid, illegal, or unenforceable provision had not been included.
Acknowledgment and Agreement:
By booking travel services through the Fun by Fischer Travel or www.funbyfischertravel.com, you confirm that you have read, understood, and agreed to these terms and conditions. You intend to be legally bound by them and acknowledge that failure to comply with these terms may result in disruptions to your travel plans for which the Agency cannot be held liable.
Please review these terms and conditions carefully before proceeding with your booking. If you have any questions or concerns, feel free to contact us for clarification before making your travel arrangements.
Governing Law, Legal Jurisdiction, and Compliance with Law Clause
Governing Law: This Agreement shall be governed by and construed following the laws of the states of Illinois and Florida, including any applicable Seller of Travel laws and regulations in those states, without regard to their conflicts of laws principles.
Legal Jurisdiction: Any legal action, suit, or proceeding arising out of or relating to this Agreement, including those related to Seller of Travel laws and regulations, shall be commenced exclusively in the state or federal courts located within the states of Illinois and Florida, as applicable. Each party hereby irrevocably submits to the personal jurisdiction of the courts within these states and waives any objection to the laying of venue in such courts based on forum non-conveniens or any other basis.
Compliance with Laws: Each party agrees to comply with all applicable federal, state, and local laws and regulations, including but not limited to Seller of Travel laws and regulations, while performing their respective obligations under this Agreement, whether those obligations are being performed in Illinois, Florida, or any other location. The parties further agree to cooperate fully with one another in any legal or regulatory compliance matters, including those related to Seller of Travel laws, that may arise in the course of performing this Agreement.
